Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Adkins Labs (a sole proprietorship of Edward McNichols) ("Adkins Labs," "we," "us," or "our") governing your access to and use of ForkScore, including the website at forkscore.ai and all associated mobile applications, APIs, and services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@forkscore.ai if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for an extended period, or are used for fraudulent or abusive purposes.

ForkScore is a recipe discovery, capture, and sharing platform. The Service allows you to:

• Extract recipes from URLs (including YouTube, TikTok, Instagram, and recipe websites) using AI technology
• Save, organize, and manage recipes in collections
• Rate, comment on, and share recipes with other users
• Discover recipes ranked by the proprietary ForkScore algorithm
• Participate in referral and partner/affiliate programs

ForkScore uses artificial intelligence (powered by Anthropic/Claude) to extract recipes from URLs and video content. You acknowledge and agree that:

• AI-generated recipes may contain inaccuracies in ingredients, quantities, cooking times, or instructions.
• You are solely responsible for reviewing and verifying all recipe content before cooking, especially regarding food allergies, dietary restrictions, and food safety.
• Adkins Labs is not liable for any adverse outcomes resulting from reliance on AI-generated recipe content.
• AI-generated food images are artistic representations and may not accurately depict the final dish.

ForkScore offers a free tier with limited usage and a paid subscription ("ForkScore Pro") at $4.99 per month (or the equivalent in your local currency for in-app purchases). By subscribing, you agree to the following:

• Billing: Subscriptions purchased on the web are processed by Stripe. Subscriptions purchased within mobile apps are processed by Apple (App Store) or Google (Google Play) according to their respective terms.
• Auto-renewal: Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings (web), the App Store (iOS), or Google Play (Android). Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.
• Price changes:We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.
• In-app purchases: Certain features or content may be available as one-time in-app purchases. All in-app purchases are final and non-refundable, except as required by applicable law or the policies of Apple or Google.

ForkScore operates a referral program that pays Referrers $1.00 per month for each Referred User they bring who maintains an active paid Pro subscription, with no cap on the number of Referred Users and no expiration on relationships already attributed.

The program is governed by separate Referral Program Terms covering eligibility, attribution, fraud, taxes, and payouts. Those terms control over these Terms in any conflict as to the program.

You retain ownership of content you create and submit through the Service ("User Content"), including recipes, comments, ratings, and collections. By posting User Content, you grant Adkins Labs a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Service.

You represent and warrant that:

• You have the right to submit all User Content you post.
• Your User Content does not infringe the intellectual property or privacy rights of any third party.
• Your User Content does not contain unlawful, defamatory, obscene, or harmful material.

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate at our sole discretion.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems
• Use automated scripts, bots, or scrapers to access the Service without our written permission
• Circumvent or disable any security features, including Cloudflare Turnstile bot protection
• Submit malicious URLs or content designed to exploit our AI processing systems
• Impersonate another person or misrepresent your affiliation with any entity
• Interfere with or disrupt the Service or the servers and networks connected to it
• Use the Service to harvest or collect personal information about other users without their consent
• Resell, redistribute, or commercially exploit any part of the Service without our written permission

The Service, including its design, code, ForkScore algorithm, brand elements, and all content created by Adkins Labs (excluding User Content), is the property of Adkins Labs (a sole proprietorship of Edward McNichols) and is protected by copyright, trademark, and other intellectual property laws.

"ForkScore," the ForkScore logo, and "Adkins Labs" are trademarks of Adkins Labs (a sole proprietorship of Edward McNichols). You may not use our trademarks without prior written permission.

The Service may process content from third-party platforms (YouTube, TikTok, Instagram, and other websites) at your direction. We do not claim ownership of third-party content and are not responsible for its accuracy, legality, or availability.

Your use of third-party platforms is governed by their respective terms of service. You are responsible for ensuring that your use of the Service complies with those terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADKINSLABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property, warranty disclaimers, indemnification, and limitation of liability.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Delaware or remotely at your election. You agree to resolve disputes on an individual basis and waive any right to participate in a class action.

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights.
